3% Tax Withholding Update

Did you know?

In November, the Veteran’s Affairs opened the nation’s largest VA Outpatient facility in Ft. Worth, Texas.

Issue: Section 511 of the Tax Increase Prevention and Reconciliation Act of 2005 (Public Law 109-222) will require, beginning in 2012, the withholding of 3% in federal taxes on payments to government contractors for goods and services.

Supported Legislation: The House approved full repeal of the 3% tax withholding in the American Recovery and Reinvestment Act (ARRA) stimulus bill of 2009. However, the Senate only passed a one-year delay of the provision. Per this one-year delay, the provision will go into effect January 1, 2012.

  • H.R. 275: House bill introduced on January 7, 2009 to repeal the 3% tax withholding requirement set to go into effect in 2012.
  • S.292: Senate bill introduced on January 21, 2009 to repeal the 3% tax withholding requirement.
  • NACM-GBG is a member of the Government Withholding Relief Coalition (GWRC)

Time to Take Action: Contact your Representative and Senators, to make sure your voice is heard and Congress continues to be aware of how detrimental a 3% withholding tax is to your business.
