TEXAS -  I fielded a question today regarding inserts and Texas notices.   I thought if one had the question others might be interested.  Here we go...

When selling a sub on a private commercial project a 15th Day 2nd Month Notice to prime is required.  Legally nothing needs to be inserted with the notice.  However, your 15th Day 3rd Month Notice to prime and owner does require you to insert either a statement or invoice copy.   Most insert a statement because it's less specific.  When selling a prime on a private commercial project the 15th Day 2nd Month notice is not required but the insert with the 15th Day 3rd Month notice is required as described above.

When selling as sub on a public project a 15th Day 2nd Month Notice to the prime is required.  Legally nothing needs to be inserted with the notice.  However, your 15th Day 3rd Month Bond Claim Notice to prime and bonding company does requires you to insert either a statement or invoice copy AND a sworn statement.   As before most insert a statement because it's less specific.  When selling a prime on a public project the 15th Day 2nd Month notice is not required but the inserts with the 15th Day 3rd Month Bond Claim Notice are required as described above.
